But we are not talking about byelaws, we are talking about legislation, and as I pointed out previously, Central Government make legislation. It's the same in Northern Ireland. The Planning Notice that informed us that pigeon lofts require planning permission isn’t a local council byelaw, it comes from the Northern Ireland Government. http://www.planningni.gov.uk/index/policy/supplementary_guidance/dgn/dgn06.htm Also I doubt if my council’s legal team would be able to offer meaningful advice on such a different planning system. Ours in Scotland is still administered by local government [the council]. The Northern Ireland planning system is administered directly by Central Government, through its Agency, The Northern Ireland Planning Service. http://www.planningni.gov.uk/index/advice/advice_legislation/advice_all_legislation.htm So the fancier isn’t dealing with a local council, he’s dealing with a government department. I think that is a difficult thing to do on your own, and as I have said, I hope that he has had a planning professional / solicitor working for him on this, but judging by the current outcome, that doesn’t look to have happened.

I hope the negative poeple never face the situation becasue if we can not change it this time then we never will. Planning can be changed and often is at appeal usally tho it is becuase some one is making money. I sugest you go talk to Nick and Bill in our club being as you think your so clever Mike. If your finger really is on the pulse though you will already know the score so quote your ideas to someone that really doesn't know! I know about all this first hand, not a 5 minute wonder, a long drawn out battle and if people in power say NO then spend the money and see just where it gets you! Same goes for you tracker!

sharkfin Posted September 25, 2009 Report Posted September 25, 2009 I think its a sign of the times that we live in .I moved to a town population 18.ooo 22yrs ago with a pigeon club with 29 members ten years ago the council decided to change their missive that no pigeons would be kept on their proerty .One by one members left the sport for various reasons over the years with no new members able to join.There is only 3 of us left if we move out our house's thats the end of the sport here and no one would care, as the majority of people think keeping pigeons is anti-social, flying rats

imindoors Posted September 27, 2009 Report Posted September 27, 2009 In our club we found about a bye-law after a new neighbour complained about the position of the loft of one of our members. Apparently after October 2007 a local law was passed that all lofts had to be not one but two metres away from any fence! (basically in the middle of the garden). Luckily he had a write up in the BHW with a picture after a good YB result that was the only proof that he could find that his loft was there for YB racing 2007, therefore okay, but he lost a lot of sleep over it. My point is that it is so difficult to keep up with these things. He was new to the area. None of us new about the change. It's not as though they are very well advertised?
danny11 Posted September 28, 2009 Report Posted September 28, 2009 i no what the guy is going through we had the same thing happen to us we where counil but they sold our houses to a housing association so all of us that had pigeons had to make sure they did not have a pets policy so we could keep the pigeon i wish him luck
showman Posted October 5, 2009 Report Posted October 5, 2009 Just a small up-date. Was talking to John and Annette to-night, and a few facts came to light which I was not aware of : 1. Since this episode began, John has been under pschiatric attention as a person who could 'self-harm' 2. Living with them is Annette's aged mother, well into her 70's I believe. She suffers from Alzheimers. Surely this family are worthy of our support !! Sncerely Paul
