sox Posted December 12, 2009 Report Posted December 12, 2009 you just cant trust anyone these days i was just about to move house and build a new loft but had to apply for permmision i got permmision to erect my loft then found out i needed to apply for to keep pigeons in it i went to speek to the neighbors if it was ok they said yes then found out one has objected against it! do the council go with the majority vote or the one whos objected ?

OLDYELLOW Posted December 12, 2009 Report Posted December 12, 2009 have had similar problems when i moved here , first i asked all neighbours for permision to the left is a house and to the right i have 6 flats , most were bothered about blocking light out so had to place loft to rear of garden not ideal but ment i could have the loft on the back garden , then had to go through the council planning department with there rules and regulations , as they hadent dealt with any loft applications they didnt have a clue how to procede any way the requirements were loft was to be 1 metre away from all perimeters or would require planning permission but i still had to provide a full detail map of land and house plus propose building and any shed that were on the garden at that time , then they said i had to pay fees of a few hundred pound , but i knew as a pigeon loft wasent classed as a perminant structure it wasent nessary and soon sorted that out . then after a few short months after having loft built after getting planning permission and birds in i was getting complaints , as all other neighbours were friendly i asked them all bar one and non had made complains . Anyway as soon i got the complaint of birds deficating all over washing and garden been a mess , i invited the housing to come at once and view my garden , i explained i had no birds flying out as they were all stock and would loose them and be stupid to do so , they said well the garden is completely spotless unlike when i had moved in as looked like a refuge site kirky can tell you how bad it was i took 3 skips off it of rubble and countless bonfires to remove wooden fences and pallets . The housing officers also commented on how well made and pleasing on the eye my loft was , the complaints dint end here they continued so i told them that i would send the complainer a letter that outlined that her complaints had no grounds and were of a venomous and vexatious and that any other false claim would see her taken too court and sued for defamation of my charicter , 3 months later she moved no complaints my neighbours love them keep your garden tidy keep your loft in a good state of repair then they cant do a thing about them , enjoy your pigeons

As long as it's not above a certain height (8ft or is it 12 but either way 8 feet is move than 98% of lofts I'd wager), length and is away from the house by a few metres nowt can or will be done. Even a Resident's Association, or pre - planned laws are not enforcible. Likewisse it would be against you rights to not give permission.
Guest IB Posted December 12, 2009 Report Posted December 12, 2009 If you rent a council property, there will almost certainly be a 'no pets without permission' clause, having that permission is part of your tenancy agreement, break that agreement and you could face eviction proceedings in court. Planning permission is different. It refers to erection and use of a building. Provided the loft is in your own back garden, and meets certain rules, e.g. maximum sizes, you have 'automatic' permission to build it, without applying. But you may still need permission from the landlord to keep pigeons in it, as above. If you live in a flat, you will almost certainly require planning permission especially if the garden ground is communal, i.e. everyone living in the block of flats has a right to use every part of the garden ground. Only those neighbours who share a boundary with your garden ground, or are within 12 metres of the loft, can object to it, and then only on certain grounds, for example amenity. One objection won't necessarily stop permission being granted. At one time I had neighbours on either side of me object to the council to my keeping racing pigeons in a shed about 8' by 6'. At hearing where all attended, Council told objectors that there was nothing they [Council] could do to stop me keeping pigeon in the shed.

fred x Posted December 12, 2009 Report Posted December 12, 2009 I had the same problum, When I retired I moved to a Bungelow with a small garden, I put up a shed 12'X8'X 6.5 hight. then I was told that I was NOT to keep Chickens or Pigeons on my propety. So I started a dove release busness for weddings ect: I got some pure white Racing pigeon & told the neighbours that they were Doves! & invited my next door neighours in to look at them. they said how beautiful they are, I have had them now for 5 years, & how wonderful they looked when they were flying around the house's, I started to race once more this season & bought in some coloured racers mixed with my whites. with no objection from the neighbours, One did say he had noticed I had some coloured pigeons flying white the whites. I told him the truth I was stated to race them I told him how we as pigeon fliers treat & look after our birds. & he has seen how clean I keep my loft, he never realised what we had to do to keep our pigeons in tip top condition. All seem well now. Next week I hope to put a 6'x4' shed to house my young birds for 2010 season :X
