If our Federation employs a driver for 20 weeks April to late August at a fixed sum per trip,is there any member of this site who can advise me how the Fed stands with regard to employment law

if you have a driver work for 26 week you have to find him another 26 weeks you have 20 week contract, you should be ok, with that

the national insurance, and the drivers insurance will be high, maybe an agency could offer better,terms, then again hold overs could escalate the cost :emoticon-0126-nerd:

Employment law is a minefield. As a solicitor I would advise you to search the law society's website for your nearest employment law specialist and see if they offer a free first consultation - usually 30 minutes. Scottish law is different to English ad Welsh law, so law society may not be able to help, but there must be an equivelant in Scotland.

Any period of employment is feasible as long as all terms of the employment ie. wages, hours, over time, conditions and job description etc etc are all stipulated on contract.

strange i would of thought it would of been cash in hand on a week to week basis

ie like paying a bill to a joiner .sparkie for doing a job for you

you dont give them a wage just pay a bill so to speak

then it would of been up to the driver to declare his payment or payments

to the inland revenue

Aye, thats the way to do it but if it was a big organisation then maybe they cant go down that road. Money in hip, for me, any day.

Also you need to consider holiday and sick pay,because after eight weeks,your entitled to both.It has recently been reduced from sixteen.Deb
