Hi All,

 

Firstly my apologies for not writing in a while.  Those of you who know me know that I am currently 7 months pregnant and still fighting this bloomin court case over my grandads will.  Its really starting to get me down as I was hoping it would be sorted before the baby is born but with my wicked aunts constantly nipping at my heels that is not going to be the case.

 

Its a bit of a difficult one as my grandad had pigeons which I am now looking after.  They are all very old now - well into their late teens, early 20's but I have grown to love them as my grandad did and it has been fun getting to know their characters.

 

I have bouight them a nice new loft and I feed them daily and cover them up at night as its been so bitterly cold and clean them regularly. We sadly lost Chicken Legs but Blackie, Drop Wing and One Eye are still going strong.

 

I stay at my grandads alot as I live over half an hour away and being 7 months pregnant it is getting harder and harderto get about and my back is in a terrible state from too much driving.

 

However my aunts are CONSTANTLY harping on about me living here, even though ALL COSTS have been met out of my own pocket, from the bills, the pigeon feed down to the new loft.

 

I need to present a case for living here after the baby is born as I will not be able to get to and from very easily at all as I want my baby to have some routine.

 

I try to go and spend time with the pigeons every day or I find they get very upset when I do go down there as they are not so used to human contact.  This is not fair on them and I refuse to jepordise their well being for my nasty aunts who, co-incidentaly wanted them destroyed when my grandad died.  I've even had to put padlocks on the lofts as I dont trust them.

 

I need evidence of how important human contact is for my babies, any report I can refer to would be great.  Also I am going to calculate how much money I have spent since I've been here and I need to somehow try to find out how much it would cost to get somebody in to care for the birds on a full time basis.  Obviously I do not want this as I love those birds but I know how motivated my aunts are by money and if they think that the cost of caring for the birds will come out of their inheritance, like it should be doing as until probate has been granted (it should be paid for by my grandfathers estate) then this should deter them from keep hassling me.

 

I dont understand it.  I am the executor of my grandfathers estate so surely its up to me how I care for the livestock.  My aunt was an executor but she renounced this so she could contest the will and try to prove my grandad was not of sound mind which is SO NOT TRUE.  My grandad was a lovely man and a real gentleman with ALL his faculites.

 

Any help anbody can give me would be so very much appreciated.  I feel like I'm drowning a bit at the moment.

Hi Nikki, sorry to hear you are still fighting over the birds.

Firstly the birds like as much contact, time spent with them as you have available but they are not going to suffer if you are not able to give it to them.

As long as they are fed and watered regularly they will be quite happy.

I don't know what your plans are for when the baby is born, if anything like here at the moment the baby has thrown everything into termoil but have you made arrangements incase you are off your feet for a while etc?

You will prob find pet sitters in your area and they may be prepared to go and feed etc while you are unable to alternatively there may be a local member on the forum prepared to look after your remaining 3 birds for a while.

Just a thought!

must be a fancier in the area that knew your grandad that can vouch for his state of mind or even a neighbour ? and surely there must be a fancier in your area that would be willing to look after the birds as 3 birds wouldnt take much seeing to i hope all goes well for you in the future all the best . Mark

Oh thanks for your replies guys but I think you are misunderstanding me.  I WANT to keep the pigeons I love them and they are part of my grandad but I need to present a case for staying at my grandads while probate is going thru.  Thats why I need some evidence of what it entails looking after pigeons and I know that you said that the birds will be ok but if I dont spend time with them they do go a bit wild and are very unsettled whereas if i'm around they seem much more content.

 

All I want to do is present my case for living here and show how expensive the other option will be of getting somebody in.  I made a promise to my grandad that I would take care of his pigeons and I am not going to let him down

True, and, with sufficient food and water down they can be left for a few days. However, this isn't what you need to hear.....  the pigeons need daily, if not more, attention in the freezing weather - someone has to check that the water hasn't frozen. It's not good to leave food down as it attracts rats and, because the birds are elderly I think that they need someone who is familiar with them and their behaviour to watch out for any illness.

  i think rspca might back u up here as the birds do need someone on hand to look after them, if you say you are willing to live there and look after them untill the outcome is known, it would be expencive to get someone in and take care of them and it would be unfair on the birds to move them due to thier age,thay shoud be left to live out the time thay have in the loft as your grandad wanted

keep to your grandads wishes where you possibly can

could be the dragons dont want new baby round , but they,ll come round when they see him or her

Many many thanks for your kind replies guys.  If anybody has any reports they know of that I can reference as this is the only kind of thing that hold up in court, I would very much appreciate a link.

 

As usual I'm running around like a blue assed fly today.  I'm just off to the hospital to go over some of my grandads medical records so I will check in again when I get back.

I dont think you realise how bad relations are here.  I've not seen or spoken to my aunts since the will was read over a year ago.  They are motivated by money and we have nothing in common.  They dont know I'm pregnant and I really dont want them to know something so personal about me any more.

I don't know of any reports that might help but if you push with the Enviromental Health issues that the area requires regular cleaning etc, that might help!

No-one wants a vermin problem!

I hope you get something sorted soon and you take care of yourself and your 'bump' .

I dont think you realise how bad relations are here.  I've not seen or spoken to my aunts since the will was read over a year ago.  They are motivated by money and we have nothing in common.  They dont know I'm pregnant and I really dont want them to know something so personal about me any more.

Another thought.....why nnot get some quotes from pet sitters - see how much they would charge to see to birds - then choose the highest quote to present to your aunts. ;)

As with all livestock, the ideal is to see them twice every day to ensure that they are safe and well. They should be fed twice each day and no feed should be left down because it could attract vermin and become stale and soiled. Water must be changed at least once per day. And obviously, their environment should be kept clean. They should be the subject of regular vetinary checks to ensure that they are healthy and free from parasites.

The cost of empolying someone would be x hours by the min wage. Aditionally, you should be able to employ someone to keep the garden etc up to scratch. Make sure you keep records and get receipts.

I am not a lawyer but I do know that English Law is founded on what is resonable. The test would always be, what would a resonable man do in these circumstances. All this will cost money and this should be the basis of a claim against the demon aunts or the estate.

I was quoted £ 38 per day to look after my dog only a few weeks ago,  :( :( :(

Slightly different slant: seen this in my own organisation's legal files: as executor, you are treated as if you were the person who's estate you are administering. As far as the Law is concerned 'You' are your grandad, until the estate is settled it's your wishes that are paramount.

 

Can't recall what your grandad's wishes were for his pigeons or his house. But clearly they have to be looked after until his estate is finally settled. You are the only one who has elected to do this, the birds are located at his former home, they require daily attention, you have difficulty travelling there every day - (presumably there may still be letters addressed there too which may or may not require your attention. Services are still connected to protect the fabric of the property (heating etc) so that definitely requires your attention.

 

Bottom line is if you require to live there as executor to better attend to grandad's estate, then you can - at least until the estate is finalised.

I'm going to investigate further the 'executorship' role and see what I can do with that.

 

It's so nice to know you guys are always on hand to offer advice.  I sometimes feel bad as I dont really have any advice to give you guys back as you all know so much more than me as regards pigeons lol!!!!!!

advice not needed, just look after the birds [and yourself and the baby far more important] and oh yes beat those old battle bags ;D ;D ;D ;D

nikki why not say it was your grandads dying wish that the birds lived the remainder of their lives in the loft and that you promised him they would and your not going to break the promise you made to your grandad this might help with your problem i hope so look after your self & the bump

Whatever you do stay away from the RSPCA ANDTHE RSPB!!! Won't be interested unless getting publicity.... MOST likely how they have had to rehome the birds or other crap.

Only see them with a collection tin in hand.

A 40 chapter book would only skim the suffice of them shower. Please, Please don't get near them, or for a fact if bother to see you, they will just make headlines getting shot of the birds. Golly can see the headlines now!

 

Genuine girl unable to look after deceseased birds' etc. and codswallop how .... need one go on?!!!!  Won't do you a jot of good, believe you believe me and the thousands that will tell you the same.
