Guest VINNIE Posted October 29, 2009 Report Posted October 29, 2009 i have been given permission by admin to post the following i have just been told that a very old friend and fellow fancier has been given 6 months notice to leave his family home of 52 years following the death of his father and partner he will be rehoused into a 1 bedroom property he is currently living in a 3 bedroom house he is currently selling his race team and stock if any new starters are looking for decent stock please pm me and i will pass on the intrest shown he has some middle distance and distance birds on offer at a reasonable price ,i will pass on his number to anyone intrested he really is gutted when he moves he will have nothing ,pigeons is his life regards vinnie

Albear Posted October 31, 2009 Report Posted October 31, 2009 Can't he take over the tenancy, has he taken advice? If he can't afford a solicitor he can go to Citizen's advice bureau. He should have some tenency right if he can prove he has lived there all that time especially if he paid towards the rent.I'm no expert on this but I feel sure he will have some tennacy rights
Guest peter.j Posted October 31, 2009 Report Posted October 31, 2009 a council / social landlords house can be passed over once if the person who wants to take up the tennancy can prove they have been a resident for at least 12 months this happened when my granny fell off the perch and my aunty wanted to keep the house
Guest strapper Posted October 31, 2009 Report Posted October 31, 2009 i know of an incidence where a m8 of mine had to fight the council to take over the tenancy from his late mother...has she had taken over it 2 years a go from her husband. my m8 has lived there for nearly 40yrs paying keep to his parents. the council decided he couldnt take over the tenancy and after a lengthy legal challenge he had to move...devastated doesnt come close so i can imagine how our m8 feels vinnie m8....as he too had to find somewhere for the birds. forgot to add thats after his legal team cost him £3.000+

joe61 Posted October 31, 2009 Report Posted October 31, 2009 vinnie your freinds circumstances have changed where he only needs 1 bedroom he needs to find a way to change them back as i said in my 1st post or get 2 sick relatives to move in with him who need looking after then go to the council and ask them to look at his case again what he needs to do is show them he needs the other 2 bedrooms oh happy days

Guest VINNIE Posted October 31, 2009 Report Posted October 31, 2009 hi thanks for all your kind replies i work for the council and have spoken to the managers about my friend the house was his grandmothers which they lived with when she passed it was handed down to his parents it cant be handed down anymore also with it being 3 bedroom it was deemed too big for him he was given temperory tenanty for 6 months now he has to bid for a vacant 1 bedroom property at least they are going to rehouse him i have known some others having to rent private many thanks vinnie
Guest IB Posted October 31, 2009 Report Posted October 31, 2009 If its a case of the guy living in a property that's too big for his entitlement, would have thought the Council would have been sympathetic to fact that there's a pigeon loft on the overaccommodated property and offered a 1 bed house with ground for a loft & permission to keep pigeons in it. Can surely refuse new tenancy on those grounds?

Have to agree, it's important he puts things in writing and gets things in writing. Tell him to go see his local councillor, most councillors will go out of their way to help .
Guest wes hall Posted November 1, 2009 Report Posted November 1, 2009 vinnie we have just been through the same thing dont be taken in by the council they are bullies my sister in law lived in this house for sixty years born there with her mother mother died cousil said she wasnt on the tenacy book so it couldnt be passed down they changed the laws in 1983 and she could succeed the tenancy to make things worse my sister in law has learning difficulties and to move her out would have killed her we were represented by a company called shelter in the yellow pages for free its worth a phone call on a brighter note we moved in with her and it has a big back garden now thers a 24ft pigeon loft on it as i couldnt have one wher i was living hope this helps ps now we are able to buy it so she can live ther as long as she wants wes
