You know what Joe it didn't even need to be my grandads dying wish cos he always knew that me and my mum would take care of those birds whatever happened and that still stands.  There is no way i'll let those birds suffer in any way because of the ugly sisters.  They are like my little friends now, well I dont know if Blackie would ever class me as a friend he's far too tough to admit to needing a friend lol.

Why don't you take the birds home with you if it is causing you so much stress. It would save you having to travel to look after them. The executor of a will cannot benefit from that will and they are there to see that the writing words on the will is executed. If there is nothing writing on the will as regards the birds then you as the executor have no powers over them.

hi nicki , seems your having a real prob, especialy at a time you could do with out any probs,, its very obviously you loved your grandad very much, you did vow to him you would take good care of his pigeons [which are now yours] i should take any points you feel valid on these postings , and approach the citizens advice, i worked with them for some time and feel sure that due to your circunstances , the c,a,b would do their best to help or advise or,,indeed supply a suitable lawyer poss, even free,,, i certainly hope all turns out well, i can imagine the anguish you are going through at the moment , i certainly wish you,  your beloved pigeons, and your near newcommer to the family very well ,,good luck :)

This is incorrect - an executor can be named as a beneficiary - its the witnesses on a will that cannot benefit

It's so nice to know you guys are always on hand to offer advice.  I sometimes feel bad as I dont really have any advice to give you guys back as you all know so much more than me as regards pigeons lol!!!!!!

Most people on here don't give to recieve so don't feel bad.  Take heed of the information sent to you via p.m, done some further checking for you and that could be one of your biggest issues.   Hopefully some members here who have good records winning XYZ amount of top level races could stand testimony to what pigeons need regarding human interaction.    

 

For those who don't understand what the heck I'm on about, I p.m'd with some advice regarding her problems and suggested that because there is no hard evidence (scientific) that is, to support the need for Pigeons to have human contact, perhaps asking one or two 'top' or 'high profile' pigeon men to give their learned opinions on the matter would help if it ever came to going to a Judge and arguing the case for.

 

I'd agree with Roland on the RSPCA aspect, they're only interested in shaking tins and having photos taken of a dramatic rescue, what they know about pigeons could be written on a stamp.    I don't like the RSPCA though, or does it show.   ;D

nikki why not say it was your grandads dying wish that the birds lived the remainder of their lives in the loft and that you promised him they would and your not going to break the promise you made to your grandad this might help with your problem i hope so look after your self & the bump

There was no suggestion from me about gaining benefit, merely an interim arrangement lasting 1 year max - the normal time allowed for winding up an estate.

 

The birds belonged to the grandfather who is now no longer with us. The birds are therefore part of his estate, and need looked after both as part of that estate, and as living animals. The estate executor therefore has every power over these birds, and the law says the executor is actually responsible for them.  What would happen if this was the late Jim Biss's birds [birds worth £000's]  and they died through neglect? The Biss estate would be denied £000s and someone would be liable for that loss. That someone would be the executor. Just touching on the animal welfare side - there could also be a prosecution for neglect.

Thanks guys I really dont want to move them as I have just paid for a brand new loft to be errected and really dont think its fair on them to move them.  Plus it would be difficult as my neighbours HATE any kind of animal and would def kick off also my lodger has a dog.  Thats why it would be easier to stay at my grandads really.

 

I've got lots of ideas though and am vry grateful for all your input.  Blackie seemed to love the snow today but drop wing wasn't impressed and one-eye so doddery she didn't even notice it lol
