Things like right of entry have always been very uncertain. To the best of my knowledge, no-one can enter your property legally unless they have a Court Order. To that extent, Police, Bailiffs and People like the RSPCA have broken the law on numberous occasions. The problem is that there is no way that you can bring an action against these people. I remember the Miners' Strike and I think that most who followed the events concerned with it, would agree that the authorities took extreme measures to force the Miners to do what they wanted them to do. They wanted to make the miners into criminals and went about their tasks with enthusiasm. There was  no recourse to the law then although the law was being broken by those whose job it was to uphold it.

In regard to the RSPB, DEFRA and bodies of that sort, I am convinced that the same conditions apply. There will be no where to go with complaints about their conduct or any violations to Human Rights that they may be caught up in.

The only hope in the long run is through the the medium of Public Opinion. If Public Opinion were to become activated on the side of Pigeon Racing or in oposition to the overprotection of the BOP then mountains would be moved. Until that happens, I'm afraid it will be business as usual for the violators. The present situation makes us behave a bit like Don Quiote when he tilted at the windmills.

 

I think customs and excise(VAT man) can, they can also seize property and bank accounts, something the police can't do without a warrent :-/ :-/ :-/

I am pretty sure that you are right about that, but as far as I know they still have to have a Court Order. I know that Social Workers have to have one to remove children from a family home. There are certain bodies that can obtain these Court Orders pretty much on the nod. That is why they can act as they do. They know that they can, more or less, do as they want because they have the legal backing to make it happen. What Judge or Magistrate would run the risk of delaying a court order in cases of cruelty to animals or children. If they got that wrong, their careers would be down the pan.

It is very difficult for a Society to regulate these things when Public Opinion is so firmly behind a lot of these bodies, aided and abeted by the newspapers of course.

As I said before, we must work at getting the Public on our sides if we ever want to change things. Silver Wings posted the fact that there is to be a course on Pigeon Racing to be run at a College at Walsall. And Jim Jenner has done a great deal to introduce the sport to the Public in America. We need a Jim Jenner here in Britain to take this sport to the Public.

In a previous post I said all animal welfare Acts contain standard clauses covering 'Powers of Inspector'. Here's a short extract from one:-

 

Animal Health and Welfare (Scotland)

Part 1—Animal health

“6E Tests and samples: Scotland

(1) An inspector may at any time enter any premises in Scotland for the purpose of

ascertaining (any or all)—

….

(2) The inspector may take such samples (including samples from any animals,

birds or amphibians on the premises) and carry out such tests as the inspector

thinks are necessary ….

 

“inspector†means—

(a) a person appointed as an inspector for the purposes of this Act by

the Scottish Ministers; or

(B) a person authorised by the Scottish Ministers for those purposes;

 

“premises†includes—

(a) any land or building; or

(B) any other place, in particular—

(i) a vehicle or vessel; or

(ii) a tent or moveable structure.

 

So what is being pushed on this thread by some as fact, is pure fiction. And on police powers and what they can and can't do, just try to prevent them doing their duty ...
