mcclaff Posted September 9, 2009 Report Posted September 9, 2009 Hi all Just wonderin if anyone can help me find a way to get John Boyd, Owner of the Emerald Classic One Loft Race to pay me the £150 that he owes me for coming 4th in a hot spot race last year, yes that's right, last year!! He did send me a cheque after the event that the bank wouldn't honour and after countless emails and phone calls i have not recieved anything but excuses and "i'll send it out next week", which i'm seriously fed up with. > Does the RPRA have any regulating authority over one loft races or can owners/organisers just do what they like??? If one loft race organisors mess people about like this is there any governing authority that holds them to account??? If so can someone please let me know so i can make a formal complaint as i'm fed up bein takin for a ride and making pointless, costly phone calls. pjc Posted September 9, 2009 Report Posted September 9, 2009 You need to find out if it was run under RPRA or IHU rules and then take it up with the relevent association/region sec.

At least it wold let prospetive competitors no what they are dealing with ;)

There is too much of this unscrupulous behaviour in the pigeon sport nowadays.I hope you get your money m8 and a written apology >
Guest Posted September 9, 2009 Report Posted September 9, 2009 There is no need to go to a solicitor, you can take this person/persons to the small claims court for just under £80, (you'll get that back after you win). You can even do it online. The fact he sent you the cheque in the first place is undeniable admission he owed you the money. It is also a criminal offence to write a cheque knowing you have insufficient funds to cover it so you could also go to the police. It does seem that many one loft races make their rules up as they go along and think they have the right to change them at whim, don't stand for it because these people are nothing short of disgusting. The problem with them is they put themselves on a pedistal by running a one loft race thinking it makes them something special and many of us fall for it saying 'bravo' and 'what a man' when in truth most of them only do it because there is something in it for them, and remember in reality every one of us racing does a one loft each season we just use our own birds. Don't get treated like a mug, let them have it and if you need any help send me a p.m. Don't leave it at the Courts either, find out if races are governed by the RPRA, I for one would love to know the answer to that question because there seems to be far too many one loft races springing up that seem to be able to do what they like when they like and have no accountability.

I organized a syndicate with 3 of my mates who all live out of the country, thought it would be a good way to keep in touch. We entered 2 birds at total cost of £250. Anyway my mates come home at Christmas for a visit each year so i kept the cheque i was sent until then to show them that everythin was above board. I tried to cash it after Christmas and it was returned by the bank. Of course i got straight on the phone to John Boyd who said he'd replace it which he didn't and the same has been happening ever since. After one call he even said he had sent a replacement out and before he would send me another he would have to check with the bank that i hadn't already cashed it. So, treated like dirt and then insulted into the bargain!! >

Guest strapper Posted September 9, 2009 Report Posted September 9, 2009 ALL one loft races HAVE to be licensed by an authority ..ie union. if i remember rightly the europa is lincensed by the whpu. what i would do is send him a letter stating that you intend to take him to a small claims court in the near future and all costs that have incured since the cheque was bounced will be added to any further costs from the date of this letter you have sent him. also that you intend to provide the bhw with all details of the said complaint . and all could be dealt with without any further fuss if you recieve the £150 within 7 days.

If that was the case he would still have a duty of care to inform you of the change because he would have known in his closing statement regarding any and all cheques cashed and outstanding, feable excuse to be honest. It also doesn't excuse the fact you haven't had your money yet, tell them you accept postal orders or cash via a special delivery service with the post office. Make sure you keep any letter to him simple and to the point, you can put in the ref: area, pre-summons notice, which in simple terms means pay up or else you go to Court. You need to show the courts that you have given this person a formal written warning of such action and even though you might have e-mails a letter in writing will always carry more strenght. Remember to send it recorded delivery, that way he can't deny recieving your letter.

Saying no one was paid out last year is rubbish. Most of the names that were in the race last year are back this year do you think they would be back if thay had not been paid?

Just for the record, and i know you haven't quoted me here, but i'm speaking on behalf of myself here, no-one else. If you believe i have been paid what i'm owed i suggest you ask John yourself as from the tone of your message you seem to at least have heard of him! I only hope that he doesn't fill your head with the same amount of "bull sh**" that i've had from him over the past year.
