sherbs Posted January 31, 2008 Report Posted January 31, 2008 Does anyone know how you stand if it says in your deeds that you can't have pigs,pigeons or poultry ? I have 4 chickens and environmental health have just been round and said someone has complained about the smell and noise. But he went away happy that there was very minimal noise and no smell. I neglected to say the shed in the corner was for my pigeons which will start arriving quite soon. Phoned planning and they said it only concerns them if it was a change of land use. CAB said it's a civil matter and the person complaining would have to go through the courts to invoke the covenince in the deeds. Anyone got any experience of this ? Would be grateful for your thoughts, Mark

Guest IB Posted January 31, 2008 Report Posted January 31, 2008 Have had a quick word with our legal department [council housing] who confirm such restrictions still exist and they have a case at the moment which they may take to court, but have no idea if they'll win because it has never been tested in Court. [Note this is in Scotland and uncertainty is down to these restrictions dating back to the old Feudal Superior system, which finally died out here in 2004. They also feel if Environmental Health and Planning have no issues, then there's little to worry about - providing its pets you keep [poultry and pigs is something to eat, you don't eat pets]. Your neighbour may still take you to court but same applies - no guarantee of a win. [Maybe worth pointing this out to them, nobody has money to waste. ]
sherbs Posted January 31, 2008 Author Report Posted January 31, 2008 Thanks guys just been round to the neighbour who i thought had most cause to complain, with the intention of tackling sensitively any complaints or worries he had, but he says it wasn't him. I suppose he would though, don't want to fall out with anyone and a bit disconcerting not knowing whose got a problem with us. All i want is a quiet life and to enjoy the birds to much to hope for i suppose. No wonder the sport is dying no one is allowed to be a bit different anymore, we all have to conform to a set model and ive in our boxes vegging on the sofa. Not me though i'm gonna kick against that a little longer or until they drag me off to court !! Thanks again Mark

Thanks again Mark good for you buddy stick with it you might find your neighbours come to love them, mine do now, they always ask whats hapening when they haven't seen them flying for a bit and some even pop round to see what they are up to they love them
Fair Play Posted January 31, 2008 Report Posted January 31, 2008 Pick some "nice coloured" birds and "unwittingly" attach the names of the neighbours wives point out to them the coincidence and the fact that they will be racing i am sure they will be inquisitive enough to ask how they are getting along and when is the first race. A bit of pigeon man psychology. ;D ;D
Guest shadow Posted January 31, 2008 Report Posted January 31, 2008 went through this problem and had to go to a soliciter his advice was to check the deeds as to any other restrictions such as are the front gardens supposed to be open plan are caravans banned from the house drive etc I looked mine up and found out the other restrictions the sent a letter to all the neighbours saying that I would abide by the covenant on not keeping poultry and pigeons if every one else abided by all the covenants regards no front hedges walls caravan parkinf etc. All complaints dried up within the week . good luck hope this helps

A few years ago now, I went through a similar situation. Federation President come knocking on my door, inspecting everything, because of the trouble I was causing etc council experts, many different ones (None of them, new the difference between a duck & a pigeon) one could say ;D ;D solicitors letters going every which way, you name it. All because some neighbour (never found out who) objected to my birds !!!! flying in his air space (would you believe it) as he put it, over his house. At the end of the day ;D ;D my birds are still doing what they do. I don't know what happen to my neighbour thou :D Finally !!!!!!! would you believe & to show you how thick !!!!!! some people can be (council) They wanted me to give them a list of all the pigeon members etc in their city. Well the fed president & I laughed over that demand "Big Time" clowns, that they were. Enjoy.
