Its an hard one but how could you not react after caring and breeding something only to see it die in front of you from a bop, we must have some rights :-/

not sure what would happen but if farmers have got rights to protect thier live stock if it were getting attacked then why shouldnt we be allowed to protect our live stock ( Pigeons ) in the same way a rule for one and a rule for another springs to mind

you dont have any, unless you pay mega money for the best lawyer money can get. then you would be lucky with a fine.

its a protected animal, a pigeon isnt regardless of ownership. it isnt good for us or the pigeon.

i know what my reaction would be to do to BOP and probly most of you on here, but what would our Legal right be if caught?

but same question ,,if a b o p killed a pet hamster , rabbit, lovebird canary [or canaries, with fright] any pet whatso-ever, expesive ones , rare ones etc etc etc,, be interesting to see a test case, and the publics re-action,, and off course the media re-action :-/ :-/ :-/

i would assume that such a case is rare, but i would be relying on public backing. i couldnt stand there and let it happen. the dogs would be on it along with an air gun

well me myself if a bird of prey was on one of my birds and i could swing for him i would and then knuckle him! its as simple same as if sum1 seen a dog rippin there cat apart they would try help another example if if a big dog tried attcking your little dog you would help!!

 

and i believe that we should have a right at least if the bird of prey is on our propertie would be handy for the closed season ;)

thats what we need the best case to fight through the courts and we find/make the money to get the best legal team to defend who ever it is not hard to get money together with sales and other fund raiseing we do it for others time we helped our own we would only need to win 1 trial case that would finnish the rspb but we would need to pick the best case for a trial case

had a sh hit my old birds today had one pinned down next to the road ran out shouting and making a lot of noise sh let go and flew BANG into a passing car  ;D ;D ;D oh and the bird didn`t have a mark on it .

You don't have any legal right to harm a bird of prey. That breaks the Law, nothing to do with RSPB, Governments make Laws, and they enforce those Laws through courts. Its Government we need to convince to change those Laws.

 

Having said that, no bird of prey will ever harm, far less kill one of my birds in front of me. That's why 'the forum advice' is to remain with your birds all the time they are out. 99% of their protection is up to the pigeons through being streetwise. 1% is down to you, for the odd occasion that they may be taken by surprise on your property, when you are their last line of defense, to scare the thing away before it even has a chance to get started on your bird. No Law against that.

He He! that doo desrves a medal. Seriously, the law has strict rules and if you can fight with the best lawer (not nessesarily the most expensive) who is on the ball and puts the work/time in on your behalf, then it is down to past cases. An example is when I was a nipper and into the trout fishing big time we used to frequent a local pond at night which was stalked with 2/3 pound rainbow trout. One night we got caught by the police and were eventually charged, not for poaching as they had to go back to a 16th century Scots law because the water was classed as a Stank ( no stream in or out ) and we were charged with theft of 4 trout. If we had no fish then nothing could have been done. If there had been a stream in or out we would have benn charged with poaching and all gear confiscated and heavy fine. We were fined the maximum penalty the judge could impose = £5. I do not know what laws have been passed regarding BOP but outcome of legal action would take these into account. After all my havering though, best advice though as stated, no evidence = no case.

a farmer does have the right to shoot a dog if its attacking live stock...but first he has to give the owner a chance to retreive the dog. if he doesnt give you warning then he can be prosecuted.

on the other hand all dogs should be controlled or never off the lead.

i think dogs and farmers are not the same prob we have thats a domestic dog thease BOP,S are wild and protected iam not saying we shouldnt be able to protect our live stock but if we won a trial case that would go a long way to solveing our prob.
